Your physical or electronic signature.
We may remove content and, if appropriate, terminate repeat infringers.
13) Disclaimers
THE SITE AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE CLUB DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR‑FREE, OR THAT DEFECTS WILL BE CORRECTED.
Information on the Site (including technical tips, routes, maps, and event details) is provided for general informational purposes and does not constitute professional advice. You are solely responsible for your decisions and vehicle operation.
14) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE CLUB, ITS OFFICERS, DIRECTORS, VOLUNTEERS, MEMBERS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR PARTICIPATION IN CLUB ACTIVITIES.
OUR TOTAL LIABILITY FOR ANY CLAIMS RELATING TO THE SITE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US FOR THE SERVICE AT ISSUE IN THE 12 MONTHS BEFORE THE CLAIM OR (B) $100.
Some jurisdictions do not allow certain limitations; some limitations may not apply to you.
15) Indemnification
You agree to defend, indemnify, and hold harmless the club and its officers, directors, volunteers, members, and affiliates from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from: (a) your use of the Site; (b) your violation of these Terms; (c) your User Content; or (d) your participation in club events or activities.
16) Privacy
Our Privacy Policy explains how we collect, use, and share information. By using the Site, you consent to our data practices as described there.
17) Changes to the Site or Terms
We may update the Site and these Terms from time to time. We will post changes with a new “Last Updated” date. Changes are effective upon posting unless otherwise specified. Your continued use after changes means you accept the updated Terms.
18) Termination
We may suspend or terminate access to the Site or your account at any time, with or without notice, for any reason, including if you violate these Terms. Upon termination, the following sections survive: 8–15, 17–21.
19) Governing Law; Venue
These Terms are governed by the laws of the State of Texas, without regard to its conflict of laws principles. Exclusive venue for any dispute arising out of or relating to these Terms or the Site is the state or federal courts located in Harris County, Texas, and you consent to personal jurisdiction there.
20) Dispute Resolution; Informal Process
Before filing a claim, you agree to first contact us at [email] and attempt to resolve the dispute informally within 30 days. If we cannot resolve it, the dispute may proceed in the courts specified above. Nothing in this section prevents either party from seeking injunctive or equitable relief.
(Optional: If you want binding arbitration instead of court, I can add a fair, Texas‑compatible arbitration clause with small‑claims carve‑out.)
21) Miscellaneous
Entire Agreement: These Terms, plus any additional event or purchase terms and our Privacy Policy, are the entire agreement between you and us regarding the Site.
Severability: If any provision is unenforceable, the remainder remains in effect.
No Waiver: Our failure to enforce a provision is not a waiver of our right to do so later.
Assignment: You may not assign your rights under these Terms; we may assign ours as part of a reorganization or similar event.
Headings: Headings are for convenience only.
